1. Acceptance
These Terms are between you and the individual developer qinghong meng regarding NightSound, whose Chinese name is 呼噜呼噜. Apple is not a party to these Terms.
By downloading, installing, accessing, or using the app, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app. Minors should use the app only after a parent or guardian has reviewed and accepted these Terms.
2. Service description
NightSound lets you record and review nighttime sound and view related records and results. Available features may vary by app version, device condition, operating system, permissions, and region.
We may maintain, change, or discontinue features and will take reasonable steps to reduce unnecessary disruption.
3. License
If you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license for personal use. You may use the app only on Apple-branded products you own or control, as permitted by the App Store Usage Rules, including Family Sharing or similar sharing where those rules allow it.
The app is for lawful personal use. No ownership interest in the app or its content is transferred to you.
4. Recording and other people
You are responsible for making sure you may lawfully record in your location. If a recording may capture another person, you must give any notice and obtain any consent required by law.
Do not record where prohibited, where a person reasonably expects privacy, or in a way that infringes privacy, reputation, intellectual property, or other rights. You are responsible for unlawful or unauthorized recording, storage, use, or disclosure.
5. Permissions and privacy
Recording requires microphone access. You decide whether to grant it and may turn it off in iOS Settings. Before using recording and other core features, you must give overall consent to the Privacy Policy, including Umeng+ usage analytics and stability diagnostics. If you do not consent, recording core functionality is unavailable. The current version has no in-app entry to separately disable Umeng+ analytics.
Our handling of information is described in thePrivacy Policy. You must also comply with applicable device, network, and third-party service terms.
6. Your content and data
You are responsible for your recordings and how you use them. Recordings and related records are kept primarily on your device. Protect your device and arrange backups where needed.
You may delete an entire record or, when available, delete only its audio. Deleted content may not be recoverable, and results may no longer be available for review or completion. To the extent permitted by law, we are not responsible for loss caused by device failure, system behavior, insufficient storage, accidental deletion, or lack of backup.
7. Not medical advice; limits of results
NightSound is not a medical device and does not provide diagnosis, treatment, emergency response, monitoring, or professional health advice. Records and results can be incomplete, inaccurate, or unavailable because of placement, ambient noise, distance, system condition, and other factors.
Do not use the app as the sole basis for a medical decision, medication change, or delay in seeking care. Consult a qualified healthcare professional about sleep, breathing, or other health concerns. Contact local emergency services for an emergency.
8. Prohibited conduct
- Breaking the law or infringing another person's rights;
- Recording, monitoring, harassing, threatening, or distributing another person's voice without authorization;
- Disrupting or bypassing security measures of the app, device, or service;
- Unauthorized copying, rental, sale, or commercial redistribution of the app;
- Reverse engineering, decompiling, or attempting to obtain non-public material except where applicable law expressly permits it;
- Using the app in a way likely to cause abnormal load, damage, or other improper consequences.
9. Intellectual property
Rights in the app, its name, interface, text, graphics, and other protected content belong to the developer or relevant rights holders. You retain rights you lawfully hold in your recordings, subject to the rights of people and content captured in them.
Email us if you believe the app infringes third-party intellectual property. The developer, not Apple, is responsible for addressing intellectual-property claims relating to the app.
10. Availability, warranties, and liability
We will take reasonable care in maintaining the app, but do not promise uninterrupted or error-free operation on every device, in every environment, or at all times. We do not promise that every record or result will be complete, accurate, or suitable for a particular purpose.
To the maximum extent permitted by law, we are not responsible for interruptions, data loss, or indirect loss outside our reasonable control. Nothing in these Terms excludes consumer rights, statutory warranties, or liability that cannot lawfully be excluded.
11. Apple-related terms
- The developer, not Apple, is responsible for app maintenance and support. Apple has no maintenance or support obligation.
- If the app fails to conform to an applicable warranty, you may notify Apple. To the extent permitted by law, Apple's responsibility is limited to refunding any applicable purchase price; the developer is responsible for other warranty matters.
- The developer is responsible, where required by law, for product claims, regulatory compliance, consumer protection, privacy, and other claims relating to the app or your use of it.
- You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism, and are not listed on a U.S. Government prohibited or restricted party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the terms that benefit them after your acceptance.
12. Termination, law, and disputes
We may reasonably restrict or terminate your license if you materially or repeatedly breach these Terms. You may stop using and delete the app at any time. Terms that by their nature should survive will remain effective.
These Terms are governed by the laws that lawfully apply to the relationship between you and the developer, without limiting non-waivable consumer protections where you live. We encourage informal resolution first; unresolved disputes may be submitted to a court or other authority with lawful jurisdiction.
13. Updates and contact
We may update these Terms when features, law, or operations change. The updated version will show a new date, and we will provide an appropriate notice for material changes.
